OpenAI’s CEO, Sam Altman, stated: “We can defend our customers and cover costs incurred in cases of copyright infringement claims. This applies to both ChatGPT Enterprise and the API.”
The compensation offer, which OpenAI calls Copyright Shield, applies to business-level users, ChatGPT Enterprise, and developers using the ChatGPT API. Free version users of ChatGPT or ChatGPT+ are not covered.
However, OpenAI isn’t the first to offer such legal protection. Nevertheless, as creators of the highly popular ChatGPT, which Altman himself stated has 100 million users weekly, they are a significant player in this field. Companies like Google, Microsoft, and Amazon have also made similar offers to users of their AI-powered generative software.
For instance, Getty Images, Shutterstock, and Adobe also offer similar financial liability protection for their image creation software.
Is a lawsuit for copyright infringement a real possibility?
Yes, it is. Several personalities have already filed several lawsuits against OpenAI for alleged use of their copyrighted work in training the chatbot. Among the plaintiffs are, for example, Jonathan Franzen, John Grisham, Michael Chabon, George RR Martin, Jodi Picoult, and others.
Companies developing artificial intelligence software like ChatGPT use billions of lines of text sourced from the internet. Naturally, this includes databases containing tens of thousands of copyrighted books. OpenAI previously stated in their declaration, ‘We are optimistic that we will continue to find mutually beneficial ways of collaboration to help people harness new technologies in a rich content creation ecosystem.’
